On February 18, 1870, the state of Texas ratified the 14th Amendment to the U.S. Constitution.

The amendment declares that everyone born within the United States, or naturalized, is a U.S. Citizen and a citizen of the state where they reside. It also declares that all citizens shall receive equal protection under the law and states cannot deny or hinder their rights as citizens.

However, in 1874, the Democrat Party regained control of the legislative and executive branche...s of the state government. They were determined to undermine 14th Amendment and replace the Constitution of 1869.

On February 15, 1876, Texas voters adopted a new state constitution which required the state government to provide for separate schools for black and white children in defiance to the 14th Amendment. The Texas amendment was overturn by the U.S. Supreme Court ruling of Brown vs. the Board of Education during the 1950’s.
