On this day in history, November 9, 1890, the South Carolina Supreme Court ruled that ballots cast in favor of Republican Congressman Thomas Ezekiel Miller were illegal.
Congressman Miller won a three-way race and defeated republican candidate Ellery Brayton and democrat William Elliott. Elliott challenged the race and the S.C. Supreme Court declared him the winner.
The court said the ballots were illegal because they had a "distinctly yellow tinge" and said "for Representative" instead of "Representative."
